Overview

As part of our recruitment process, AMH Life Services Ltd (“The Company”) collects and processes personal data relating to job applicants in order to support employee recruitment.

The Company takes the security and privacy of your data seriously. We need to gather and use information or ‘data’ about you, the ‘data subject’, as part of our business and to manage our relationship with you. We intend to comply with our legal obligations under the Data Protection Act 2018 (the ‘2018 Act’) and the EU General Data Protection Regulation (‘GDPR’) in respect of data privacy and security. We have a duty to notify you of the information contained in this policy.

By making your personal information available to The Company, you confirm that:

You are under no obligation to provide personal data to The Company during the recruitment process. However, if you do not provide the information, we may not be able to process your application properly or at all.

The company will hold data in accordance with our Data Retention Policy. A copy of this can be obtained from the Privacy Officer / GDPR Owner. We will only hold data for as long as necessary for the purposes for which we collected it.

The Company is a ‘data controller’ for the purposes of your personal data. This means that we determine the purpose and means of the processing of your personal data.

This policy explains how the Company will hold and process your information. It explains your rights as a data subject. It also explains your obligations when obtaining, handling, processing or storing personal data in the course of working for, or on behalf of, the Company.

This policy does not form part of your contract of employment (or contract for services if relevant) and can be amended by the Company at any time. It is intended that this policy is fully compliant with the 2018 Act and the GDPR. If any conflict arises between those laws and this policy, the Company intends to comply with the 2018 Act and the GDPR.

How we define personal data

Personal data’ means information which relates to a living person who can be identified from that data (a ‘data subject’) on its own, or when taken together with other information which is likely to come into our possession. It includes any expression of opinion about the person and an indication of the intentions of us or others, in respect of that person. It does not include anonymised data.

Sensitive Personal Information’ refers to data concerning certain legally identified information, such as race or ethnic origin, criminal history, religion, sexual orientation, or trade union membership. The Company does not request or consider information concerning religion, sex life or political opinions in connection with recruiting.

Collection of Personal Information

By consenting to this notice, you agree that The Company may collect personal information from you and third parties, such as background check providers, recruiters, or references, subject to your consent where required by applicable local law.

Processing and Retention of Personal Information

The Company processes personal information for legitimate HR and business purposes, such as identifying and evaluating applicants for The Company positions, maintaining personnel files, analysing The Company hiring process, and conducting background checks, where permitted by applicable local law.  In addition, personal information may be used to comply with The Company’s legal and regulatory requirements. If an applicant is hired, The Company may use an employee’s personal information in accordance with The Company’s Data Protection Policy for Employees, Workers and Consultants.

Unless otherwise informed, The Company may retain and use your personal information to consider you for other positions.  To have your personal information removed, you may contact The Company Privacy Officer.  Personal information will be retained for a maximum of 6 months or less where required by law.

Transfer of Personal Information

The Company may be required to disclose certain personal information to other third parties, such as to law enforcement authorities when permitted by applicable local law or in an emergency where health or safety necessitates disclosure. We do not send your personal data outside the European Economic Area. If this changes you will be notified of this and the protections which are in place to protect the security of your data will be explained.

Sensitive Personal Information

In some circumstances, The Company may perform employment background and criminal checks where permitted by applicable law, and may process other sensitive personal information, such as race or ethnic origin, criminal history, religion, or sexual orientation when relevant for a position and permitted by law.  You will be provided notice and the opportunity to consent.  If you have a disability and would like The Company to consider an accommodation, you may provide that information during the recruitment process.  If you make sensitive personal information available to The Company, you consent to the collection and processing of such sensitive data.

Security and Confidentiality

The Company takes security and organisational measures to protect the integrity, confidentiality, and availability of personal information.   The Company limits access to internal systems that hold applicant personal information to individuals who need access for a legitimate business purpose, such as HR support.

Applicant Access Requests, Complaints and/or Objections

Applicants may request access to their personal information or revoke consent for The Company’s use.  For example, you may take any of the following actions: You have the right not to consent or to withdraw your consent later. To withdraw your consent, you should contact the Privacy Officer / GDPR Owner.
